Contents
This course in international, European and comparative asylum- and refugee law focuses on international and European legal instruments. In particular, the role of European Union law is becoming more and more central in comparative law, in the national law of the Member States and as a model for legal policy. With the adoption in December 2005 of the Asylum Procedures Directive the first stage of the creation of a so-called Common European Asylum System (CEAS) was completed. In 2012 the second phase of the CEAS should have been completed, but negotiations are still ongoing. The CEAS covers all aspects of asylum law: return, allocation, qualification for protection, procedures for qualification and secondary rights. In contrast to the protection of asylum seekers and refugees under the UN Refugee Convention and the European Convention on Human Rights, the CEAS rules are part of the legal order of the European Union and form an integral part of the legal systems of the Member States which courts are bound to apply.This course is designed to provide students with substantive knowledge and understanding of the increasing European Union engagement with asylum law. The course will look at the competences of the Union as regards asylum. It will analyse the existing law, application and the developments.
